Cuisineria: The Flavors of Joy

SERVICE AGREEMENT

This Service Agreement (“Agreement”) is entered into between Cuisineria LLC, hereinafter referred to as “Cuisineria,” and the individual or entity booking services, hereinafter referred to as the “Client.”


This Agreement governs culinary services provided by Cuisineria, including Private Dining Experiences, Cooking Classes, Catering, Family Kitchen Plan/In-Home Meal Preparation, and other agreed-upon culinary services (“Services”).


By booking, purchasing, or accepting Services from Cuisineria, the Client acknowledges that they have read, understood, and agreed to the terms below.

 

1. Service Description:

  • Private Dining Experiences: Cuisineria offers personalized, farm-to-table private dining experiences  prepared and served within the Client’s home or another agreed-upon location. 
  • Cooking Classes:  Cuisineria provides interactive cooking classes designed to educate and engage participants while preparing food under the guidance of Cuisineria chefs.
  • Catering:  Cuisineria provides catering services for private gatherings, corporate functions, celebrations, and other events according to the menu and service details agreed upon with the Client.
  • Family Kitchen Plan / In-Home Meal Prep: Cuisineria provides customized in-home meal preparation services designed around the Client’s household needs, preferences, dietary restrictions, and selected service plan.


Depending on the agreed-upon plan, Services may include menu planning, preparation of breakfasts, lunches, dinners, snacks, meal components, sauces, broths, beverages, freezer meals, or other agreed-upon items; portioning and packaging; labeling; refrigerator and freezer organization related to prepared foods; grocery assistance or shopping when specifically requested; and reasonable cleanup of the food preparation workspace.


The exact menu, quantities, frequency, and scope of Services will be established between Cuisineria and the Client.


2. Booking and Confirmation:

  • Client Infotmation:  The Client is responsible for providing complete and accurate information requested by Cuisineria, including contact information, household information relevant to the Services, dietary preferences, food allergies, intolerances, medical dietary restrictions disclosed for food preparation purposes, and other information reasonably necessary to perform the Services.
  • Profile Form Completion: To secure private dining experiences or cooking classes, the Client is required to complete the respective Private Dining Profile Form or Cooking Class Profile provided by Cuisineria.
  • Deposit Requirement: Services are confirmed upon receipt of a non-refundable deposit. The deposit amount will be communicated during the booking process and is essential to secure the reservation.
  • Availability: Confirmation of services is subject to the availability of Cuisineria. Clients are encouraged to book well in advance to ensure their preferred dates and times.
  • Timely Arrival: Cuisineria will arrive at the agreed-upon time on the scheduled service date. The Client agrees to provide reasonable and timely access to the home, kitchen, cooking area, appliances, and other areas necessary to perform the agreed-upon Services.
  • Accessibility: If Cuisineria cannot access the property or reasonably perform the Services because access has not been provided, the appointment may be treated as a late cancellation.
  • Kitchen Area Guidelines:  For safety, sanitation, and efficiency, the Client agrees to make reasonable efforts to keep children, pets, guests, and unnecessary distractions away from the primary food-preparation area while Cuisineria is actively working. 


3. Cancellations:

Cancellation and rescheduling requirements may vary according to the type of Service booked and will be communicated at the time of booking or within the applicable proposal.


  • Private Dining, Catering & Cooking Classes:  Deposits are non-refundable unless otherwise stated in the Client’s proposal or invoice. Because these Services require advance scheduling, menu development, ingredient purchasing, and preparation, cancellations or significant changes should be communicated as early as possible. Any cancellation terms stated on the Client’s proposal, invoice, or booking confirmation will govern that reservation.
  • Family Kitchen Plan / Recurring Meal Prep: Clients should provide at least 48 hours’ notice to cancel or reschedule a scheduled meal-preparation session. Sessions cancelled with less than 48 hours’ notice may be subject to the full scheduled service fee or may be considered used for that service week. Any groceries, specialty ingredients, supplies, or other non-refundable expenses already purchased specifically for the Client remain the Client’s responsibility regardless of cancellation. Cuisineria understands that emergencies and unforeseen circumstances occur and may make reasonable exceptions at its discretion.


4. Menu Planning and Proposals:

  • Collaborative Menu Creation: Cuisineria will work with the Client to develop menus appropriate for the selected Service, preferences, dietary needs, and agreed-upon scope.
  • Cluent Responsibility:  The Client is responsible for reviewing proposed menus and communicating requested changes, restrictions, dislikes, allergies, or other concerns within the requested review period. Approval of a proposed menu indicates that the Client has reviewed the listed meals and ingredients to the best of their ability and has communicated known dietary concerns to Cuisineria.
  • Written Correspondence: To ensure clarity and accuracy, all menu-related communication will be conducted in writing via email. This method allows for a detailed and documented exchange between Cuisineria and the Client.
  • Proposal Confirmation: Menu proposals must be reviewed and confirmed by the Client by the valid through date stated on the quote. For private dinners, final confirmation and any necessary adjustments must be made at least 72 hours before the scheduled service date.
  • Menu Adjustment: Ingredient availability, product quality, seasonality, food recalls, or other unforeseen circumstances may require reasonable substitutions or menu modifications. When a substitution could materially affect a known dietary restriction or allergy, Cuisineria will make reasonable efforts to communicate with the Client before making the substitution.

Farm-to-Table Philosophy:

  • Cuisineria is committed to sourcing the finest ingredients through a farm-to-table approach. Our chefs prioritize local vendors as the primary source for ingredients, promoting sustainability and supporting the community. In instances where specific items are unavailable, we extend our sourcing to local food providers.

 

5. Food Allergies, Intolerances & Dietary Protocols:


  • The Client is responsible for informing Cuisineria in writing of all known food allergies, intolerances, sensitivities, dietary restrictions, and other food-related requirements affecting any person who may consume food prepared through the Services.
  • Cuisineria will take reasonable precautions to follow the dietary information provided by the Client.
  • However, Cuisineria cannot guarantee that food prepared in a Client’s home kitchen will be completely free from allergens or cross-contact. The Client’s kitchen, appliances, cookware, utensils, storage containers, pantry products, previously opened ingredients, surfaces, and other household items may have been exposed to allergens before Cuisineria’s arrival.
  • The Client acknowledges this limitation when requesting in-home food preparation for individuals with food allergies.
  •  Cuisineria must be notified promptly of any change to household allergies or dietary restrictions before the next scheduled Service.
  • Dietary Protocols: At the Client’s request, Cuisineria may prepare foods according to dietary frameworks or protocols such as gluten-free, dairy-free, allergen-conscious, elimination diets, autoimmune protocol (AIP), anti-inflammatory eating patterns, or similar dietary approaches.
  • Cuisineria provides culinary services and does not diagnose, treat, cure, or prevent medical conditions. Menu planning and food preparation services are not a substitute for medical advice or individualized nutrition therapy from a physician, registered dietitian, or other qualified healthcare professional.
  •  The Client remains responsible for determining, in consultation with their healthcare provider when appropriate, whether particular foods or dietary protocols are suitable for themselves or members of their household.


6. Client-Provided Groceries & Ingredients:


  • For Services in which the Client purchases or supplies groceries, the Client is responsible for obtaining the requested ingredients in sufficient quantities and having them available before the scheduled Service. 
  • Cuisineria will make reasonable efforts to inspect ingredients before use and may decline to use ingredients that appear spoiled, damaged, contaminated, improperly stored, expired, or otherwise unsuitable.
  • Cuisineria is not responsible for inaccurate manufacturer labeling, undisclosed ingredients, manufacturer cross-contact, product recalls not reasonably known at the time of preparation, or contamination that occurred before an ingredient came under Cuisineria’s control.
  • If a requested ingredient is unavailable, missing, or unsuitable, Cuisineria may adjust the menu, omit the affected item, or use an appropriate available substitute after considering the Client’s disclosed dietary restrictions.
  • When grocery shopping is provided by Cuisineria as an additional service, grocery costs and any applicable shopping, delivery, or mileage charges will be communicated separately. 


7. Home Kitchens:

  • Suitable Workspace: The Client agrees to provide a reasonably clean, sanitary, functional, and safe kitchen in which Cuisineria can perform the Services. This includes reasonable access to working refrigeration, freezer space when required, running water, electricity or gas as applicable, food-preparation surfaces, and agreed-upon appliances and equipment.
  • Kitchen Condition: If the kitchen requires significant cleaning or organization before food can be safely prepared, Cuisineria may charge an additional $100 cleaning fee. If conditions present a food-safety or personal-safety concern that cannot reasonably be corrected, Cuisineria reserves the right to discontinue or postpone the Service.
  • Equipment: When Client-owned appliances, cookware, utensils, storage equipment, or other kitchen items are used, the Client is responsible for ensuring that such equipment is functional and reasonably safe for its intended use. Cuisineria will exercise reasonable care when using Client property but is not responsible for ordinary wear, pre-existing damage, equipment malfunction, or breakage resulting from defective or improperly maintained equipment.
  • Cleanup: Upon completion of the Service, Cuisineria will clean and organize the primary areas and equipment used during food preparation and will make reasonable efforts to leave the workspace in a condition comparable to or better than its condition upon arrival. 
  • Decorations and Table Setting: If decorations and a specific table setting are part of the agreed-upon service, it is the responsibility of the client to ensure these elements are available upon the chef's arrival. Clear communication regarding any specific requirements for decorations and table setting will contribute to a seamless and well-executed dining or cooking class experience.

 

8. Home Kitchens:


This section applies specifically to Family Kitchen Plan and other meal-preparation Services in which food remains in the Client’s possession after Cuisineria leaves. 

  • Packaging and Labeling: Prepared foods will be portioned, packaged, and/or labeled as appropriate based on the agreed-upon Service and available storage containers. Labels or Kitchen Guide instructions may include information such as the name of the food, refrigeration or freezing guidance, reheating instructions, cooking instructions, or recommended consumption timeframe.
  • Containers: Food may be packaged in containers provided by the Client or Cuisineria, according to the agreed-upon Service. Client-provided containers must be clean, food-safe, appropriately sized, and in usable condition.
  • Refrigerator and Freezer Space: The Client is responsible for ensuring adequate refrigerator and freezer space is available before the scheduled Service. Cuisineria may reasonably organize prepared foods within the designated refrigerator or freezer space but is not responsible for the overall condition, temperature performance, or subsequent operation of Client-owned refrigeration equipment.
  • Food Handoff: Once Cuisineria has completed preparation and appropriately stored or otherwise transferred the prepared food to the Client, responsibility for the food’s continued storage, handling, reheating, cooking, thawing, serving, and consumption transfers to the Client. The Client agrees to follow any storage, reheating, cooking, thawing, or consumption instructions provided by Cuisineria.
  • Food that has been left unrefrigerated for an unsafe period, improperly stored, improperly thawed, inadequately reheated or cooked, or kept beyond its recommended consumption period should be discarded.
  • Cuisineria is not responsible for deterioration, contamination, illness, or injury resulting from improper handling or storage occurring after food has been transferred to the Client’s control, except to the extent caused by Cuisineria’s own acts or omissions for which liability cannot lawfully be waived.


9. Invoices and Accepted Payment Options:

  • Invoices and payment schedules will be communicated according to the Service selected.
  • Family Kitchen Plan and recurring meal-preparation Services may instead be billed weekly, per service session, or according to another payment arrangement agreed upon between Cuisineria and the Client. Unless specifically stated otherwise, the culinary service fee does not include the cost of groceries or Client-requested specialty products.
  • Additional services—including grocery shopping, specialty sourcing, additional meals, snacks, beverages, desserts, freezer meals, or other add-ons—may incur additional charges. 
  • Deposit Requirement: Deposits may be required to reserve Private Dining, Catering, Cooking Classes, or other special-event Services. 
  • Late Fees and Credit Card Processing: Late fees of 10% and a 2.7% credit card processing fee will be applied to outstanding balances not settled within 15 days after the service date.
  • Accepted Payment Methods: Checks, direct bank transfers, or Zelle payments are accepted. Credit card payments will incur an additional 2.7% processing fee.
  • Gratuity Acknowledgment: While gratuity is not enforced, it is genuinely appreciated. Clients are encouraged to express their appreciation for exceptional service through gratuities.


10. FOOD SAFETY ACKNOWLEDGEMENT & ASSUMPTION OF RISK


  • The Client acknowledges that preparing, storing, transporting, reheating, serving, and consuming food involves inherent risks, including foodborne illness, allergic reactions, burns, cuts, slips, equipment-related injuries, and risks associated with heat, electricity, gas, knives, appliances, and other cooking equipment. 
  • Cuisineria agrees to exercise reasonable care and follow appropriate food-handling and sanitation practices while performing the Services.
  • The Client acknowledges that certain food-safety factors may be outside Cuisineria’s control, particularly when Services are performed in the Client’s home or when prepared food remains in the Client’s possession following the Service.
  • Such factors may include the condition and sanitation history of the Client’s kitchen and equipment; Client-provided ingredients; undisclosed allergies or dietary restrictions; refrigerator or freezer performance; interruption of electrical service; subsequent handling of prepared foods; failure to follow storage, cooking, thawing, or reheating instructions; and food consumed beyond its recommended storage period.
  • The Client knowingly assumes the ordinary and inherent risks associated with consuming and handling prepared food, except to the extent an injury or loss results from conduct for which liability cannot lawfully be waived.


11. RELEASE, INDEMNIFICATION & HOLD HARMLESS


  • To the fullest extent permitted by applicable law, the Client agrees to release and hold harmless Cuisineria LLC and its owners, employees, contractors, and agents from claims arising from risks inherent in the Services or circumstances outside Cuisineria’s reasonable control.
  • The Client further agrees to indemnify and hold harmless Cuisineria LLC and its owners, employees, contractors, and agents from third-party claims, costs, damages, or expenses arising from the Client’s breach of this Agreement, failure to disclose known allergies or dietary restrictions, unsafe conditions within the Client’s property, misuse or improper handling of prepared foods after handoff, or failure to follow food-storage, cooking, or reheating instructions.
  • Nothing in this Agreement is intended to waive, release, or limit liability that cannot legally be waived or limited under applicable law.


12. Client Acknowledgement


By accepting this Agreement, the Client acknowledges that:

  • They have read the Service Agreement in its entirety.
  • They have had the opportunity to ask questions regarding the Services.
  • The information they have provided regarding food allergies, intolerances, dietary restrictions, and household requirements is complete and accurate to the best of their knowledge.
  • They understand that Cuisineria cannot guarantee an allergen-free environment when preparing food in a Client-controlled kitchen.
  • They understand their responsibilities for storing, reheating, cooking, thawing, serving, and consuming foods after the completion of meal-preparation Services.
  • They voluntarily agree to the terms of this Agreement.
